Co-Ownership and Partition of Property Among Family Members

Family properties me akshar co-ownership hoti hai – multiple siblings, heirs, ya relatives ka joint share. Jab tak sab ke relations theek hain, arrangement chal jata hai. Dispute tab hota hai jab koi “apna hissa alag” chahne lagta hai – yahi se partition ka concept aata hai.

Co-owner ke basic rights:

  • Entire property ka possession jointly enjoy karna,
  • Proportionate share in income (rent, crops, sale proceeds),
  • Consent ke bina major structural changes oppose karna.

Partition do tareeke se ho sakta hai:

  • Amicable – family settlement deed, mutual division, drawing of lots, etc.,
  • Through court – partition suit, commissioner appointment, maps and valuations, final decree.

Agar property physically divide nahi ho sakti (chhota flat, single shop), to court sale order kar sakti hai aur proceeds shares ke hisab se distribute hote hain.

Family level pe writing, clear mutation, and separate possession arrangements disputes ko kam kar sakte hain. “Sab k saath hi hai” attitude emotionaly acha lagta hai, lekin legal clarity ke bina next generation me conflict almost guaranteed hai.
