Limitation Periods in Civil Suits: What Happens When You File Late

Civil law me limitation period ek invisible deadline jaisa hai. Aapka right valid ho sakta hai, lekin agar aap bohot der tak sue hi nahi karte, to court aapka case entertain karne se inkaar kar sakti hai.

Har type ka claim ke liye alag limitation hoti hai – contract recovery, property dispute, defamation, specific performance, etc. Clock usually tab start hota hai jab cause of action arise hota hai: breach hua, refusal hua, ya injury hui. Kuch cases me continuing wrong ke liye clock har din reset ho sakta hai.

Agar aap deadline miss kar dete ho, to defendant easily “barred by limitation” ka defence utha sakta hai. Court normally sympathy pe case revive nahi karti; limitation strict rule hota hai. Limited exceptions mil jate hain – jaise fraud jab late discover ho, minority, insanity, ya statutory extension provisions.

Practical effect yeh hai ki “chalega, baad me dekh lenge” approach dangerous hai. Log compromise hope me, family pressure me, ya cost fear me sue karna late kar dete hain. Saal–do saal baad jab decide karte hain, tab limitation ka trap trigger ho jata hai.

Isliye jaisi hi serious dispute dikhe, basic legal opinion le lena smart move hai – chahe aap turant case file na bhi karo, at least deadlines clear ho jate hain.
